			<content:encoded><![CDATA[<p>The process of applying for and getting a social security disability or SSI benefit claim is a frustrating one because there is no fixed time period and no guarantee that the Disability Law and Social Security Law will work in your favor. All around the country the process seems to be taking much longer and getting more frustrating. It is now taking much longer to start the initial social security application and appeals process. One of the reasons that could be causing this delay is the increase in the number of people claiming disability benefits due in part to the economy and the increase in health issues. The slow economy has not helped matters either since jobs are now much more difficult to find and especially for people living with a disability.</p>
<p><strong>Possible Problems during Application</strong></p>
<p>The Disability Law and Social Security Law were designed to cater for those who have genuine claims and so it takes a while to be able to vet each claim made. Many claimants suffer during this process because they genuinely do not have a source of income and so they end up getting broke as they await their claim to be resolved.</p>
<p>In some instances the Disability Law and Social Security Law are working because some cases only take about 30 days to be resolved and so the claimant doesn’t end up getting broke because of waiting years for their claim to be processed. However unlike other programs like the Department of Social Services, the Social Security Disability does not have deadlines for when applications and appeals are resolved.</p>
<p><strong>How Long Does It Take to Resolve an Application</strong></p>
<p>There is no clearly defined time line on when a claim is resolved using the Disability Law and Social Security Law and it can take from 30 days to two years. The process usually involves making an initial claim, a reconsideration which takes about 3 to4 months and if your claim is denied during this stage then you can apply for a hearing before an Administrative Law Judge. When making a social security disability or SSI benefits claim you should be prepared to wait from about 3 months to two years.</p>

The word felony can be traced back to the common law that was practiced in England. Here, a felony was defined as a crime that constituted the lawful seizing of a criminal’s property while the rest of the crimes that were committed were considered to be less serious than felonies. Many countries that practice common law have presently done away with the previous distinct differences between felonies and misdemeanors. The differences that have been established now cover offenses that can be indicted and those that are minor without the need for a full trial. The United States of America still adheres to the distinction between misdemeanors and felonies and this is applied on a wide scale. The American government describes felonies as crimes that result in death sentences or imprisonment that exceeds a period of more than a year. If the crime results in a sentence of one year or less, this is a misdemeanor.</p>
<p>Felonies that commonly take place include physical attacks, violent assault, violent robberies, drug dealing, deliberately burning down property, car theft, rape, destruction of property that belongs to the government and murder. In a broader sense, the term felony can be divided in terms of felonies that are violent and those which are not violent.</p>
<p><strong>How Circumstances Affect Categorization<br />
</strong><br />
Certain offenses have some similarities and these can be categorized in terms of whether they are misdemeanors or felonies. This is highly dependent of the circumstance surrounding the crime. An example of this is a situation where one illegally manufactures, distributes or sells drugs. This would ideally be referred to as a felony. However, owning a small amount of the substance is a misdemeanor or crime that is less serious. Possessing a dangerous weapon is largely considered to be legal. If the weapon is found in an area that is restricted such as a learning institution, this is a very serious crime even before the person’s intentions are established.</p>
<p>The penalty for a felony is imprisonment for not less than one whole year. Another form of punishment is the death penalty for serious offenses like death.</p>
<p><strong>Sentences for Felony Crimes<br />
</strong><br />
Before 1776, when the American and British judicial systems were separated, the common law held that a felony was to be punished through a death sentence or confiscation of belongings. Presently convicted felons are punished in various ways and the seriousness of this punishment extends from character monitoring and evaluation to time behind bars. The death sentence is reserved for people who commit serious crimes such as planned murders.</p>
<p>American law has a provision for further felony punishments that include restriction of the right to vote, exemption from certain jobs, challenges regarding certain employment opportunities, inability to gain access to a number of licenses as well as exemption from the right to purchase specified weapons. Felons can also be exempted from political activities. It is also possible for an individual to gain a divorce from a convicted felon without the need for an extensive trial. The loss of certain rights does a lot to make an individual’s life much more difficult and this loss of rights that the judge makes clear is known collectively as the consequence of charges that are criminal. Felons who are not citizens of the United States are often deported after they are sentenced to a specified form of punishment.</p>

<p>Generally, insurance companies in the United States are expected to follow similar regulation and law as other business types; whether in land usage, wage and hour, tax and securities regulations. There are additional regulations under the insurance law that insurers are expected to follow.</p>
<p><strong>Regulators in Insurance Companies</strong></p>
<p>In the regulation of the business of insurance under the insurance law, the intention is to assure the insurance companies of solvency. Therefore the regulation governs reserve policies, rates and capitalization among other process in the operations office</p>
<p>In the United States, insurance law is handled by individual states through an administrative agency. The Department of Insurance comprises departments assigned to handle insurance being headed by an Insurance Commissioner. Other states may have different names for the regulators. The agencies or the departments of insurance have the authority to put together systems that involve groups of administrative regulations for the governing of insurance companies within the states. The regulation of insurance under insurance law is exclusive for each state. The departments are also given different names for their agencies and regulators. Insurance regulation has been exempted from federal regulation for majority of cases.</p>
<p><strong>History of Insurance Company Regulation</strong></p>
<p>Different insurance policies can be traced to different times. The health and car insurance schemes are more recently traced to the 20th century while limited policies can be placed at 17th and 18th centuries. The origins generally are different from one country to another, hence different insurance laws. Many countries regulate insurance companies using laws, guidelines and independent commissions as well as regulatory bodies.</p>
<p>Insurance law in different countries protects the policy holder against bad faith claims by the insurer and ensures premiums are not too high or inflexible. These regulators also ensure that the policies and contracts are of the right standard. The issue of fixed price is an issue that can also be handled under insurance law.</p>

One form of a visual disorder is total blindness, which is an inability to distinguish light from dark - resulting in a total lack of vision. A severe reduction in vision is known as low vision or visual impairment which cannot be compensated for by corrective lenses. This will reduce a person’s ability to function at a certain level when attempting to complete certain tasks. Severe visual impairment can also be referred to as “legal blindness” if the best possible visual correction is 20/200 (or worse), in the eye with the best visual acuity. This term can also apply to a person who has a better than 20/200 visual acuity, but possesses a visual field of 20° or less (reduced peripheral vision).</p>
<p>A Snellen chart is a tool that is used to measure visual acuity using letters of different sizes (large ranging down to small) that are to be read (one eye at a time) from a range of 20 feet. The designation of 20/20 (normal) vision is determined by the ability to read the 20 foot line from a distance of 20 feet. If the letters that are read from a distance of 20 ft. need to be larger than the 20 foot line, then that larger chart number is placed under the 20 ft. number. For example, if, at a distance of 20 feet, the smallest line that can be read is the 200 foot line, then that person is said to have a visual acuity of 20/200.</p>
<p>The World Health Organization (WHO) has defined visual impairment using 5 categories:</p>
<ul>
<li>Low vision 1 refers to a best corrected visual acuity of 20/70.</li>
<li>Low vision 2 begins at a best corrected acuity of 20/200.</li>
<li>Blindness 3 is visual acuity below 20/400.</li>
<li>Blindness 4 is below 5/300.</li>
<li>Blindness 5 is no light perception at all (NLP).</li>
<li>A visual field between 5° and 10° (A normal visual field is approximately 120°) is assigned category 3; less than 5° is assigned to category 4, (this applies even if the tiny spot of central vision has perfect visual acuity).</li>
</ul>

Carrying a huge load on such a huge vehicle and over long distances is not an easy feat, and the driver will need to exert considerable effort to stay alert and avoid fatigue. But in fact, truck accidents do happen because of the inability to conquer driving fatigue. Not only are lives on the road at stake, but also the very business that the truck driver maintains through this daring job. It becomes an important task to identify the causes that lead to driver fatigue.</p>
<p><strong>Sleep Deprivation</strong></p>
<p>With the extraordinary work hours that truck drivers keep, lacking enough rest or sleep is a very high possibility. Driving over long distances with deadlines to keep can pressure truckers to keep going long after their bodies have been spent. Such scenarios encourage continuous sleep deprivation, impairing performance of a variety of tasks inherent to the truck driving business, including operating equipment (i.e., the truck) and staying alert on the road. As well, the “2 a.m. slump”, the period from 2 a.m. to 6 a.m. during which a person runs a higher risk of fatiguing, has been the cause of many accidents.</p>
<p><strong>Counterproductive Federal Policy</strong></p>
<p>But instead of arguing on the side of truck drivers and general road safety, the opposite seems to be happening. Perhaps in response to calls for longer hours of service for the trucking industry, Congress has been passing legislation that increase truckers’ work hours on the road, for example, Title 49 of the Code of Federal Regulations. The law allows Interstate truck drivers to drive 11 hours in a work period. A study by the National Central University in Taiwan has shown that 80 minutes of non-stop driving can make motorists dangerous on the roads.</p>
<p><strong>Sleepy Is Deadly</strong></p>
<p>While the statistics of driver fatigue-related crashes is underrepresented, it is believed that it is the cause of 20 to 24 percent of vehicular accidents.  A study by the Adelaide Centre for Sleep Research also shows that drivers who have had no sleep for 24 hours exhibit the driving performance of an intoxicated person with blood alcohol content of 0.1g/100ml. In the United States, the National Transportation Safety Board has observed that 52 percent of 107 single-vehicle accidents involving big trucks are fatigue-related and estimates that about 56,000 sleep-related road crashes occur annually in the USA.</p>

According to AAA-Foundation for Traffic Safety blown out tire remnants are the leading cause of road debris along the highways. They estimate that this tire debris is responsible for over 25000 accidents and at least 100 fatalities a year. While trucks are not responsible for all of this debris they do contribute a significant amount.</p>
<p>Most drivers have had the experience of driving behind a truck that has peeling tires. They try to get out of the way of black tire remnants flying through the air, they maneuver around the truck, some trying to alert the truck driver to the hazard his tires are causing other drivers. Some may alert law enforcement if they feel the truck driver is indifferent to the problems he is causing.</p>
<p>There are many reasons why tires go bad. These include tread separation, which weakens the tire until it begins to split and fall away. Another reason is underinflated tires. All drivers should make regular checks on their tires to make sure they are properly inflated. Truck drivers should always include this in their pre-trip checks and after they have traveled a set amount of miles.</p>
<p>Another reason tires destruct is because they are in poor condition in the first place. Many spare tires lay unused for years and are rotted by the time they are pulled out and out on a vehicle. Truck drivers must make sure that they have good spares available or change their tires if they appear to be worn.</p>
<p>Sometimes tires go bad and treads begin to burn due to a combination of high speeds and high temperatures. Trucks speeding down the highways can eventually build up so much heat and friction on the tires that the treads begin to burn and separate. High air temperature can accelerate this process. Blown out tires can happen on new tires that have little wear or tear, if the conditions are right.</p>
<p>Bad tires cause accidents in several ways. They can suddenly make a truck uncontrollable, sending it off the road or across lanes into other traffic. If the tire debris flies into the air it can obstruct visibility for all the vehicles in the area, including the truck driver. If the debris begins hitting other cars it can distract the driver and panic them, causing the driver to run off the road or collide with other vehicles.</p>
<p>Any of these incidents or accidents may bring about lawsuits. Investigators will have to determine who is liable for any legal or civil penalties. The costs can be high, especially if others were injured or died. This is why truck drivers must always practice good maintenance on their vehicles, making sure tires are in condition and properly inflated. They also need to change their driving habits and avoid excessive speeding that could lead to tire deterioration.</p>

It is also more accurate than relying on memory.</p>
<p>Make sure to write things down as soon as you can.  Start with where the accident occurred.  Make a list of all of the people that were involved and at the scene. 			<content:encoded><![CDATA[<p>Many nursing facilities get by working short staffed.  By 2010, this is expected to get worse.  There is an estimated need for 45% more nursing home and long-term care facility workers.  Our populations are growing increasingly older.  Many abuse cases go unreported or just get lost in the system.</p>
<p>Nobody should be the victim of nursing home abuse.  It is a terrifying experience to know that a loved one has been mistreated.  There are approximately 17,000 nursing facilities in the United States.  There are an estimated 1.6 million residents that depend on these facilities to provide them with proper care and treatment.</p>
<p>One out of five Americans will be a senior citizen in 2030. It is predicted that two of the five people will require long-term care.  The number of people needing long-term care is expected to quadruple in the middle of the 21st century.</p>
<p>Institutional abuse includes physical, mental, emotional, and sexual mistreatment.  Neglect of a patient’s basic needs is the most frequent form of abuse.  This makes sense due to the number of facilities that lack adequate staff.  Three main factors are said to lead to abuse.  Stressful working conditions, having staff that is not adequately trained to handle the residents properly, and psychological conditions that occur in demanding occupations.</p>
<p>When a nursing home case is brought into a courtroom, the accused people and facility will have an extremely strong defense.  If abuse evidence can be proven, the victim will receive compensation.  In very serious cases, nursing homes are closed down.  There are statutes of limitations that pertain to abuse cases.</p>
<p>If you suspect abuse, get the names of all people who take part in your loved one’s daily care.  Gather proof and documentation of any wrongful treatment and abuse.  Make sure your loved one receives proper medical care for injuries or mental status changes.  Take photos of any abuse related injuries and markings.  Make sure to have a Sarasota personal injury attorney that is experienced in nursing home and institutional abuse cases.</p>

<p>Sen E. Kirsten Gillibrand, DN.Y., who chaired the Senate at the time, missed the vote in committee, but relayed his &#8220;yes&#8221; by the president, Senator Barbara Boxer, D-Calif.</p>
<p>The legislature has proposed the bill to annul the two decisions of the Supreme Court of the United States in 2001 and 2006, which restricts the scope of the federal Clean Water Act, adopted in 1972. The developers said they wanted to be sure that wetlands, streams and other surface waters are not immune to significant federal regulation, and they seek only to return to the federal law of agency interpretation before the courts.</p>

It is a Breathalyzer instrument which automatically locks the ignition if the driver has a BAC above 0.08 percent.</p>
<p>Under the bill, a person convicted a first time of using the device for five months, a second conviction would require 12 months, a third in 24 months and so on until to a period of three years.</p>
<p>Those convicted of DUI would also need to read and report on these <a href="http://www.alcohol-rehab-guide.org" target="_blank">Alcohol Rehab Guides</a> before their sentence is complete.</p>
